Kathmandu Metropolitan City's Decision on Parking Fees Upheld by Patan High Court

The decision made by the Kathmandu Metropolitan City not to collect parking fees from service users is set to be implemented. The way for implementation was paved when the Patan High Court issued an interim order in favor of the metropolis.

Kathmandu Metropolitan Municipality has resolved not to charge service users for parking vehicles in various residential and commercial buildings. However, in opposition to this decision, the complex developer Leisure Association filed a writ against the metropolis in the Patan High Court.

During the hearing of this writ on the 22nd of Shrawan, the single bench of Judge Rajendra Kharel requested a written response from the Kathmandu Metropolitan City. The court issued a temporary order, preventing any interference in the charging of parking fees within the commercial complex until the 30th of Shrawan.

In the aforementioned order, both parties were summoned for a discussion on the 30th of Shrawan to determine an interim order.

Following the discussion involving both sides, the court issued an interim order in favor of the metropolis.

The Kathmandu Metropolitan City, under the Economic Act of 2080, has stipulated that commercial buildings cannot impose parking fees. According to the Financial Act, the Metropolitan Municipality has not prohibited the collection of parking fees from anyone other than its customers.
