Aryal takes IB to court for trying to sack him

KATHMANDU, JUN 19 -

Executive director of the Insurance Board (IB) Binod Aryal has filed a case against it at the Supreme Court for making preparations to sack him.

The IB had asked for clarification from Aryal for the second time in 15 days about why he should not be fired as he is facing charges of corruption and fraud. In the writ filed on Tuesday, Aryal claimed he had been framed by IB chairman Fatta Bahadur KC.

On June 13, the IB had given Aryal three days to submit an explanation why he should not be dismissed. According to the letter sent by KC, Aryal has been accused of falsifying his curriculum vitae to get his present job. The IB said it was taking action against him as per its Employee Service Bylaw 2011.

The IB has accused Aryal of holding an executive position in other organizations even while serving at the board which went against the requirements of its job vacancy notice published on Feb 4, 2012. The IB said Aryal was found to be involved in Aryal Construction Trading and Consultancy and Bristi Tours and Travels as director. However, Aryal said in his writ that he transferred his shares in these companies to his relatives after he was appointed as the IB’s executive director.

Aryal has also been charged with misusing his position by forcing an insurer to pay compensation for damage caused by an excavator owned by Aryal Construction. However, Aryal said that he was not alone in endorsing the policy. “All the board members of the IB should take moral responsibility for the case if it is proven wrong,” he added.

Aryal blamed KC for plotting against him. According to him, KC chaired the recruiting committee when he was hired as the IB’s executive director. “It is against the principle of natural justice that KC first okayed the appointment and later said it was wrong in order to sack me,” said Aryal.
